    The greek law: Albanian churches, voting centers



    The Albanian orthodox believers must think twice before deciding to go and pray in any church on some Sundays. It might not be a surprise that on that day the church will have been transformed into a polling center for the members of the Greek minority in Albania. At least this is the project of the Karamanlis government, which is still under discussion in the Parliament of our neighboring country. The draft-law on the voting of the self-declared ethnic Greeks living outside of Greek borders foresees that they will be provided the opportunity to cast their ballot from their country of residence. The voting will be organized not only in Greek embassies and consular offices across the world, but also on the territory housing Orthodox churches. In order to implement this project, the Greek state needs the permission of the Albanian Orthodox Autocephalous, which is Albanian and not Greek.

    The Greek Oddity
    The Karamanlis government has promised all Greek citizens that live around the world that they will be granted the right to vote just like their fellow nationals living on Greek soil. In accordance with this promise, the government has drafted a law that will enable Greeks to vote in the first elections after January 1st, 2010. At the same time, even Albania has made efforts in providing this right to hundreds of thousands of Albanians living in other countries such as Greece or Italy. However, what is odd about the Greek law is the article that delineates the location of the polling stations where the voting will take place. Apart from the embassies and consular offices, it is foreseen that voting will also take place on the grounds of Orthodox churches. In the case of Greek citizens living in Albania, this caveat becomes a bit more complex because the Albanian Orthodox Church does not take orders from the Greek state. The Albanian church does not belong to the Greek minorities and its estates, including places of worship, are at the service of the Albanian Orthodox believers.
    The spirit of this specific article is clearly conceited because it implies that Albanian Orthodox churches are placed under the jurisdiction of the Greek state. This is a Greek attempt to undermine our national integrity, a very crucial part of which is the Albanian Orthodox Church itself. The Greek project might have been acceptable if it specified that Greek citizens could vote on the territories of Greek Churches outside the country. For example, Greeks that live in Russia could vote on the territory of Greek churches in that country, but it is inconceivable that the Russian Church would allow any such thing to occur on the church grounds under its own jurisdiction. Orthodox Churches are divided in many nations (between indigenous and Greek), but in Albania we do not have Greek Orthodox churches that are separate from the Albanian ones. All Orthodox churches are under the jurisdiction of the Albanian Orthodox Autocephalous Church (AOAC).

    What does the law say
    The Minister of Internal Affairs, Pavlopulous, proposes in his draft-law that all self-proclaimed ethnic Greeks living outside the country, who hold Greek citizenship and are registered in the National Registry, will be endowed with the right to vote. The Greek Prime Minister, Karamanlis, approved and supported this initiative.
    This draft-law foresees that self-proclaimed ethnic Greeks will be able to vote in national elections held after January 1st, 2010, that is after the nation's next Parliamentary elections. According to the estimates of the Ministry of Internal Affairs, the number of Greek citizens holding residence abroad does not surpass 300.000 while, according to these 'homogenous' Greek organizations, their overall number across the globe may actually reach a figure as high as one million voters. The draft-law includes details outlining the possible voting venues, the deadlines, the procedures to be followed, the institutions responsible for monitoring these procedures, etc.
    It is quite interesting the fact that in the abovementioned draft-law, it is foreseen that, the voting process in countries with Greek citizens, will be carried out in electoral centers as foreseen in the law. Therefore they will be located in embassies or consular offices in various countries. In addition, other offices can serve the function of polling centers, more specifically those located in the territories of orthodox churches, Greek-owned shops and other Greek-owned agencies, as well as the offices of Greek organizations in the respective countries. In order to implement a regular and correct voting process, special voting registries will be compiled under the supervision of high judiciary officials appointed by the Supreme Court of Greece. The voting boxes will be sent to Greece and will be stored in the offices of the First Degree Court. The number of votes' results will be added to the results of internal voting under the leadership and the supervision of the Central Electoral Committee. However, despite the adding of the results from abroad there will be no changes in the number of electoral areas, as that is only influenced by the internal National Registry of Greece.

    Albanian Laws
    There is no law in Albania that regulates the relations between the state and the religious communities. In the year 1999, the Committee of Cults was created after an order of the Prme Minister. But still there is no law or rule that compels the religious communities to inform the Committee on their activities. The constitution requires bilateral agreements between the state and the religious communities but no such agreement has been signed so far. The Committee of Cults has drafted an agreement some years ago that was to be signed by the religious communities' representatives but this initiative was forgotten. However the constitution speaks clearly about the activities of religious communities and also stipulates that "there is no official religion in Albania".
    According to the basic document of the state, the relations between the state and the religious communities are regulated based on agreements between the Council of Ministers and representatives of these communities. These agreements are ratified at the Assembly. "Religious communities are legal entities. Therefore, they have independence in administering their funds according to their own interests as long as they do not harm a third party," says the Constitution. The Chair of the Committee of Cults at the Ministry of Culture, Mr. Rasim Hasanaj says for MAPO that Albanian laws strictly forbid using religious venues for other purposes, such as political. Albanian Churches have an essential, non-electoral raison d'źtre" says Hasanaj.

    The Karamanlis Campaign
    The Minister of Interior Affairs, Public Administration and Decentralization, Prokop Pavlopulous and the MP from PASOK in opposition, Vangelous Venizelos held some meetings with representatives of the Council of the Greek Diaspora. Throughout the talks with the Stefanos Tamvakis, the Chair of the CGD, the participants focused on the draft law of the Greek government that would give the right to vote to Greek citizens who live outside their territory. The Minister Pavlopulous made public the decision of the Greek government to create an 'ad hoc' commission which will cooperate with the Council of the Diaspora to identify Greek citizens that live outside the country.
    The decision of the Karamanlis government that will enable Greek citizens living abroad to vote in their country of origin, should not be seen as separate from another decision made: that of massively granting Greek citizenship to members of the Greek minority in Albania. "These are diabolic comments," was the reply of the Minister of Foreign Affairs, Bakojanis who was asked whether issuing Greek citizenship to the Greek minority members in Albania was an electoral bubble before election time. The case of the massive issuing of citizenships was an issue of old debates between the Greek and the Albanian governments. In fact, the Greek Minister of Internal Affairs, Pavlopulous contacted his former counterpart in Albania, Olldashi, since the summer of 2006.
    "My position is that all member states of the EU grant citizenship to all immigrants working there as soon as possible. It is not the passport that changes your nationality or your national identity. This is an action to make the lives of citizens with Albanian origin that live and work in the EU," declared Berisha in broad daylight, while 'forgetting' that the law does not foresee Greek passport for immigrants, but for members of the Greek minority who live in Albania. The Minister of Foreign Affairs in Greece, Dora Bakojanis declared after the decision, that the law included all Greek minority members who live in Albania and who bear the homogeneity card, while failing to mention Albanian immigrants who live and work in Greece.
    The Prime Minister's advisors wrote a confidential report on the consequences that the Greek law would have on Albanian immigrants as well as on Albania. More then 120 thousand minority members have started procedures to be granted Greek citizenship, while Albania, officially acknowledges 30 thousands of Greek minority members in Albania. It goes without saying that tens of thousands of Albanians have declared themselves as Greek only to be able to bear a Greek passport. Specialists say that with this massive issuing of citizenships, there are good chances that the number of Greek minority members in Albania artificially increases and, consequently, the Greek claims over Albanian territories would also rise again.
    "Bearing in mind Greek claims over the numbers of Greek minority in Albania to be much higher that what the Albanian state has declared as well as the differentiating policies, and preferential treatment for some parts of the Albanian population, like the population of Himara, the Vllehs and the orthodox believers in general (so far there are numerous examples of visa issuing, unjustified pensions, business sponsoring, scholarships etc,) we think that apart from Greek minority members, many other Albanians will declare themselves of Greek origin. Experience to this day with green cards, showed that the number of Albanians registered as Greek nationals superseded even the previsions of the Greeks themselves," says the report of our Prime Minister's advisors. Prime Minister Berisha completely ignored the report.

    “Ēudia” greke
    Qeveria e kryeministrit Karamanlis u ka premtuar tė gjithė nėnshtetasve grekė qė jetojnė nėpėr botė se ata do tė kenė tė drejtėn e votės njėlloj si bashkėatdhetarėt e tyre qė jetojnė brenda territorit tė shtetit grek. Nė vijim tė kėtij premtimi, qeveria ka hartuar njė projektligj qė do t’u mundėsojė grekėve tė votojnė nė zgjedhjet e para pas 1 janarit tė vitit 2010. Kjo ėshtė njė drejtė, tė cilėn edhe Shqipėria po pėrpiqet ta zbatojė pėr qindra mijėra shqiptarėt qė jetojnė jashtė territorit tė Shqipėrisė, nė Itali, Greqi apo vende tė tjera. Mirėpo, ajo qė tingėllon e ēuditshme nė ligjin grek ėshtė neni qė flet pėr qendrat e votimit ku do tė realizohet procesi zgjedhor. Krahas ambasadave dhe konsullatave, votimi parashikohet tė kryhet edhe nė territorin e kishave ortodokse. Nė rastin e shtetasve grekė qė jetojnė nė Shqipėri, kjo ēėshtje ndėrlikohet pasi Kisha Ortodokse Shqiptare nuk merr urdhra nga shteti grek. Kisha Shqiptare nuk i pėrket minoritetit dhe pronat e saj, duke pėrfshirė dhe kishat, u shėrbejnė besimtarėve ortodoksė shqiptarė. Ky nen i ligjit grek ėshtė ndėrtuar me njė frymė arrogante pikėrisht sepse vihet re pėrpjekja pėr tė futur kishat ortodokse shqiptare nėn juridiksionin e shtetit grek. Kjo pėrpjekje e grekėve cėnon integritetit kombėtar, pjesė e tė cilit ėshtė edhe vetė Kisha Ortodokse Shqiptare. Projekti grek mund tė ishte deri diku i pranueshėm nėse do tė specifikohej se shtetasit grekė do tė votojnė nė territorin e kishave greke jashtė atdheut. P.sh, grekėt qė jetojnė nė Rusi, mund tė votojnė nė territorin e kishave greke nė kėtė vend, por as mund tė mendohet se Kisha ruse do t’a lejojė kėtė tė ndodhė nė territorin e kishave qė ka nėn juridiksionin e vet.
    Nė shumė vende tė botės, kishat ortodokse janė tė ndara, kurse nė Shqipėri nuk kemi njė kishė ortodokse greke tė veēantė. Tė gjitha kisha ortodokse janė nėn juridiksionin e KOASH-it.

    Ē’thotė ligji
    Projektligji i ministrit tė Brendshėm, Pavlopulos qė u jep tė drejtėn e votės tė gjithė homogjenėve grekė jashtė territorit shtetėror, tė cilėt kanė nėnshtetėsinė greke dhe janė tė regjistruar nė regjistrin themeltar tė gjendjes civile, ka gjetur pėrkrahjen dhe mbėshtetjen e kryeministrit grek Karamanlis.
    Ky projektligj parashikon qė homogjenėt grekė do tė mund tė votojnė nė zgjedhjet kombėtare tė pėrgjithshme qė do tė zhvillohen pas 1 janarit tė vitit 2010, pra pas zgjedhjeve tė ardhshme parlamentare. Sipas vlerėsimeve tė ministrisė sė Brendshme, ky numėr nuk i kalon tė 300 mijė votuesit, ndėrkohė qė sipas parashikimeve tė organizatave tė homogjenėve grekė, numri i tyre anembanė globit mund tė kapė shifrėn 1 milionė votues. Nė projektligj pėrcaktohen tė gjitha detajet lidhur me vendin e votimit, kohėzgjatjen, procedurat qė duhet tė ndiqen, institucionet pėrgjegjėse qė do tė monitorojnė kėto procedura etj.
    Tėrheq vėmendjen fakti se nė projektligjin e sipėrpėrmendur parashikohet qė: votimi do tė kryhet nė ato vende ku banojnė grekė, nė qendra zgjedhore tė parashikuara nga ligji, qė do tė funksionojnė brenda konsullatave dhe pėrfaqėsive diplomatike jashtė vendit, por edhe nė zyra tė tjera qė mund tė funksionojnė brenda territorit tė kishave ortodokse, tė dyqaneve tė komunitetit grek apo zyrave tė shoqatave greke nė vendet pėrkatėse. Pėr tė realizuar njė proces votimi tė rregullt dhe korrekt, do tė hartohen regjistra tė veēantė votimi nėn mbikėqyrjen e funksionarėve tė lartė tė gjyqėsorit qė do tė caktohen nga Gjykata e Lartė e Greqisė. Kutitė e votimit do tė dėrgohen nė Greqi dhe do tė ruhen nė gjykatėn e shkallės sė parė. Rezultatet e votave nėn drejtimin dhe pėrgjegjėsinė e Komisionit Qendror tė Zgjedhjeve do t’u bashkohen votave tė brendshme. Me shtimin e rezultatit tė votave qė do tė vijnė nga jashtė Greqisė nuk do tė ndryshojė numri i zonave elektorale nga dalin deputetėt, pasi ndarja e tyre influencohet vetėm nga regjistrimi i popullsisė sė brendshme greke.

    Ligjet shqiptare
    Nė Shqipėri nuk ka njė ligj qė rregullon marrėdhėniet e shtetit me komunitetet fetare. Nė vitin 1999, me urdhėr tė kryeministrit u ngrit Komiteti i Kulteve, por nuk ka asnjė ligj apo rregull qė i detyron komunitetet tė informojnė Komitetin pėr veprimtarinė e tyre. Kushtetuta kėrkon marrėveshje dypalėshe mes shtetit dhe bashkėsive fetare por deri tani asnjė e tillė nuk ėshtė nėnshkruar mes palėve. Komiteti i Kulteve ka pėrgatitur njė marrėveshje-tip disa vite mė parė pėr t’u nėnshkruar me komunitetet fetare, por iniciativa u la nė harresė. Pėr veprimtarinė e komuniteteve fetare flet qartė Kushtetuta e cila specifikon se “nė Republikėn e Shqipėrisė nuk ka fe zyrtare”. Sipas dokumentit themeltar tė shtetit, marrėdhėniet ndėrmjet shtetit dhe bashkėsive fetare rregullohen mbi bazėn e marrėveshjeve tė lidhura ndėrmjet pėrfaqėsuesve tė tyre dhe Kėshillit tė Ministrave. Kėto marrėveshje ratifikohen nė Kuvend. “Bashkėsitė fetare janė persona juridikė. Ato kanė pavarėsi nė administrimin e pasurive tė tyre sipas parimeve, rregullave dhe kanoneve tė tyre, pėr sa nuk cenohen interesat e tė tretėve”, thuhet nė Kushtetutė. Kryetari i Komitetit tė Kulteve pranė ministrisė sė Kulturės, Rasim Hasanaj thotė pėr revistėn “MAPO” se ligjet shqiptare e ndalojnė kategorikisht pėrdorimin e objekteve tė kultit pėr qėllime jofetare. “Shteti shqiptar ėshtė laik dhe ai respekton komunitetet fetare. Por Kushtetuta dhe ligjet shqiptare ndalojnė pėrdorimin e objekteve tė kultit pėr qėllime tė tjera. Kishat shqiptare kanė funksion fetar, jo elektoral”, thotė Hasanaj.

Pėrvoja e deritanishme me kartat jeshile, tregoi se numri i shqiptarėve tė regjistruar me kombėsi greke, i tejkaloi edhe parashikimet e vetė grekėve”, thuhet nė raportin e kėshilltarėve tė kryeministrit, qė u injorua nga Berisha.
