    "Where an individual has received refugee status by deception, for example by posing as a national of another country, it is possible to cancel that status and the leave granted to that individual.
    "There are also powers under immigration legislation that allow us to prosecute such individuals.

    Secretary of State ka te drejte qe te terheqi mbrapsht cdo lloj refugee statues, qe eshte dhene ne fallcifikim- sic eshte shprehur gazetari me lart.
    Shteti anglez po krijon ligj mbas ligji qe te uli numrin e aplikanteve, ashtu edhe numrin e ilegaleve ne UK.

    Kesaj rradhe me duket ke bere me te vertete lajm dhe ja ke arrit qellimit, shpresoj te jete aq i verte sa ai lajmi qe dhe para disa ditesh qe do u jepen dokumentat Shqipetareve ne Angli , dhe u ngrite mendjen te gjtheve kot me kot.

    Muhammed ti duhet ta kesh bere ne shkolle patjeter qe impakti i lajmit te keq eshte shumefish me i madh sesa ai i lajmit te mire , te kuptoj qe je "strugling" me qene ne qender te vemendjes por nqa do nje keshille vellai jot mos i ngacmo shume ato te homme office se edhe per ty dine shume gjera LOL

    Me shprehje si "Ka filluar ti ngrije buzqeshjen ne buze", une nuk kuptoj pse ti cuditesh nga pergjigjet qe ke marre.

    Jo vetem qe ke raportuar ne menyre te ashper duke lene te nenkuptosh sikur shqiptaret po zgerdhiheshin te gjithe, por edhe ke raportuar dobet pa permendje konkrete faktesh dhe te dhenash.

    Ty mund te duket vetja sikur po treguhesh i zgjuar me shprehje te tilla por kjo menyre raportimi nuk mund te pritet njesoj nga shqiptaret. Ti nuk po shkruan per The Sun ose Daily Mail. Shkrime te stilit tabloid dhe sensacionalist nuk duhen vleresuar por ne fakt duhen percmuar nga gazetare te mirefillte.

    Ndaloje ket tip gazetarie dhe mbase ruaje ndopak integritetin tend kur fillon te besh ndonje artikull dhe mundet te arrish diku.

Ne rradhe te pare ata persona qe pretendojne se jane te punesuar diku dhe qe kane mundesi te transmetojne nje informacion apo dine dicka dhe kane kalur lajmin e alarmit te mediat (mediat jane vetem transmetues te lajmit dhe jo burime te informacionit), per temen me te nxehte ndonjehere ne UK, psh, neneshtetesia do t'ju hiqet menjehere apo se edhe "viktimat" do te perfundojne ne burg per 2 vjet apo edhe te tjere perfaqsues te institucioneve shqiptare ne Londer duhet te kerkojne falje publike. Une personalisht kam ne shqyrtim raste te tilla prej Qershorit te 2005 dhe se edhe pse une kam kontakte me mediat si Shqiptare ashtu edhe Londineze nuk e kam dhene nje alarm te tille, pasi kam menduar dhe gjykoj se rastet jane vetem individuale. Psh. nje rast qe tek une eshte paraqituar ne Qershor 2005 jo vetem qe neneshtetesia britanike eshte perfituar si shqiptar nga Kukesi por edhe bashkimi familjar nepermjet ambasades Britanike ne Tirane eshte bere pa asnje problem. Para dy javesh tek zyra ime eshte paraqitur edhe nje person tjeter por se perseri deshiroj te theksoj se nuk ka nje fushate spastrimi. Nga alarmet e eksazgjeruara shume njerez po vuajne nga stresi dhe se une personalisht kam marre telefonata se shume shqiptare po pergatiten te largohen nga UK. Ato burime informacioni qe kane transmetuar keto lajme ne media apo qe japin intervista me subjekte kontradiktore, pra qe flasin ndryshe nga nje gazete ne tjetren per interesa perfitimi te kerkojne falje publike gjithe shqiptareve sa me shpejt te jete e mundur, ndryshe do te kekoj qe burimet e informacioneve te dalin para drejtesise. Jam i gatshem te sakrifikoj per hir te se drejtes ashtu sikur kam bere ne pranveren e 1999-es ku nuk hezitova tu bashkengjitem rradheve te UCK-se per interesa kombetare dhe se eksperienca nuk me mungon ne te gjitha aspektet.

    No Amnesty, No Regularization!!!

    Rumours have been flying around about a new amnesty/*regularization, none of it sourced, none of it correct.

    Inaccurate information gives persons seeking asylum and irregular migrants seeking status, false hope.

    There is also much confusion over 'Legacy cases' and this is pretty much the fault of the Home Office for not providing clear and accurate information on the issue.

    Immigration Law Practitioners' Association (ILPA) have kindly permitted NCADC to circulate the briefing below, which gives an outline of what the Home Office 'Legacy cases' may mean and what the Home Office may intend, none of the information below has been finalized by the Home Office.

    Legacy Cases - ILPA information sheet - April 2007

    In July 2006, the Home Secretary announced that there was an asylum "legacy" of around 450,000 cases, and the Home Office would clear this legacy within 5 years. To deal with these legacy cases, the Home Office have established a separate directorate - the legacy directorate.

    What is a legacy case?
    A legacy case is any case where all of the following apply:

    there has been a claim for asylum

    the Home Office records indicate that the case has not been concluded

    the case is not being dealt with by the New Asylum Model (NAM)

    A claim for asylum will include a claim for humanitarian protection or discretionary leave, whether or not a claim for asylum under the Refugee Convention was made.
    Cases dealt with by NAM cannot become legacy cases. Similarly, it is not possible for a legacy case to transfer to NAM. (For information on NAM please see the separate information sheet called "New Asylum Model".)

    The Home Office have not provided comprehensive or clear information regarding legacy cases. ILP A is still seeking clarification from them. However, it seems that legacy cases will include:

    cases where the asylum claim remains outstanding

    cases where there is an outstanding appeal

    cases where asylum has been refused and any appeal dismissed, but the individual remains in the UK

    cases where a fresh claim for asylum has been made (a separate information sheet on "Fresh Claims" will be produced shortly)

    cases where the individual has been granted some form of leave to enter or remain, but this is limited and may need to be renewed (e.g. an unaccompanied child granted discretionary leave; a person granted discretionary leave for medical reasons)

    cases where the individual has been granted 5 years refugee leave or humanitarian protection and may apply for indefinite leave to remain at the end of that period

    cases where the individual has left the UK but the Home Office records have not been updated

    Home Office legacy directorate
    It is intended that, by the summer, there will be 1,000 Home Office staff working in the legacy directorate. They will not all be caseworkers with the authority to make decisions on individual cases. The legacy directorate will work through all the legacy cases.

    The Home Office will consider a legacy case concluded when the individual has left the UK or been granted leave to remain in the UK. Working through a legacy case may include dealing with an appeal to the Asylum and Immigration Tribunal. The Home Office will treat a legacy case as closed if they cannot contact the individual, but they will first make what they consider to be reasonable efforts to make contact.

    Prioritizing cases
    The Home Office have identified four criteria for cases, which they will prioritise. Those criteria are:

    cases of individuals who may pose a risk to the public

    cases of individuals who may easily be removed

    cases of individuals receiving support

    cases of individuals who may be granted leave to remain

    However, the Home Office have said that it may be difficult for them to assess which cases are priority cases and which are not. They have confirmed they will select cases, so far as they can, according to the criteria. If a case is selected and it is found it does not fall within the criteria for prioritising, the caseworker will nevertheless work it through to conclusion.

    Home Office legacy letters and questionnaires
    The Home Office have been sending standard letters in response to letters or applications for further leave to remain from individuals who fall within the legacy cases. The Home Office letters have in the past simply stated that the individual's case will be concluded within 5 years. They have now confirmed that the letters will be changed. All cases will be concluded by July 2011. That is 5 years from the Home Secretary's announcement.

    Receiving a standard letter does not indicate that a caseworker is actively dealing with the case. It indicates only that the case is regarded as a legacy case. The letter gives no indication when, within the period up to July 2011, the case will be dealt with. Home Office practice has been to send information on making a voluntary departure with the letter. This does not mean the individual should be expected to leave the UK.

    When the Home Office select a legacy case, they send a questionnaire to the individual. This means the case is being actively dealt with by a caseworker, and will be dealt with through to a conclusion.

    Legacy is not a regularization process
    Some people think the legacy questionnaire indicates the Home Office have begun a new 'amnesty' exercise for granting indefinite leave to remain to people in order to clear their backlog. This is not correct. The Home Office may grant leave to remain to some individuals. However, this will only happen if the individual's circumstances meet existing criteria for a grant of leave to remain.

    Asking the Home Office to deal with a case
    It may be possible to ask the Home Office to treat a case as a priority. Legal advice should be sought before someone asks that their case is treated as a priority. Even if the Home Office do prioritise a case, there is a risk this results in a decision that the person should be removed from the UK.

    200,000 'lost' asylum seekers may stay

    More than 200,000 failed asylum seekers may stay in Britain indefinitely because they cannot be traced.
    Officials have conceded that nearly half of the 450,000 "legacy cases" in which the applicants are left in limbo may never be cleared.
    Ministers have flatly ruled out an amnesty and have pledged to remove everyone not entitled to be here within five years.
    Some "legacy" cases date back 15 years and experts believe the Government will not be able to fulfil its pledge to clear the backlog by July 2011. Officials attending a recent meeting to discuss the legacy policy were told that half of the 450,000 are "untraceable".
    They were also told that 18,000 foreign nationals who have committed crimes in Britain were earmarked for deportation, the first time an official figure has been given.
    Damian Green, the Conservative immigration spokesman, said: "It is concerning that there may be such a large number of foreign criminals possibly at large and that the Government is admitting defeat by writing off up to 200,000 lost asylum seekers."
    Sir Andrew Green, the chairman of Migration Watch, said: "It is time they [the Government] came clean to the public about the possibly serious implication for the asylum system."
    A Home Office spokesman said: "We remain confident that we will be able to clear the entire current legacy of cases by July 2011."
    The Home Office is already reviewing the cases of 4,000 failed asylum seekers in Scotland after pressure from the executive in Edinburgh.
    As immigration is not a devolved matter, this move could be significant for policy in England, where most of the unsuccessful asylum seekers live.
    Many countries, including America, have regularisation programmes for failed asylum seekers or illegal immigrants. Spain has just completed its fifth amnesty.
    But a Commons committee last year said an amnesty in Britain would encourage the view that breaches of the immigration rules may be rewarded and undermine confidence in the system.
    Last week's Whitehall shake-up left immigration in the hands of the Home Office but day-to-day policy will be handed over to a new Borders agency which comes into being today.
    Also from today, any foreign national wanting to settle here will be required to take tests in the English language and the British way of life. This brings long-term immigrants into line with people who seek UK citizenship, who already have to sit the tests.
    Last year 180,000 people were granted settlement to stay. Some go on to seek British nationality but others may choose to retain their own while staying permanently.
    The Government believes migrants wishing to live in the UK permanently should properly integrate and understand the society they are joining.
    Applicants who already possess a good standard of English will take the existing Life in the UK exam. Immigrants with poorer English can take a specially developed English for Speakers of Other Languages course with a simplified citizenship course.
    The Life in the UK test is aimed at those with a good grasp of English and their pass mark will be at least 75 per cent. Each applicant sits a 45-minute exam of 24 questions to show a basic knowledge of national culture.
    Those less accomplished in English can attend a combined language and citizenship class instead. They will be expected to complete the course "successfully" but do not have to pass the exam to gain citizenship.
    A government handbook, Life in the UK, contains much of the information that will feature in the tests, including what to do if you spill someone's pint in a pub (offer to buy another).
    Some immigrants and asylum seekers have cheated their way to UK citizenship by buying answers to the Home Office "Britishness" test.
    Mandarin-speaking Chinese have paid £150 for the list in London's Soho, so they know which boxes to tick when they take the exam.
    Now the Home Office has changed the questions, although applicants who studied the previous handbook are still allowed to take an exam based on the old questions.
