There is an inscription on a plaque at the base of the Statue of Liberty. It says "Give me your tired, your poor. your huddled masses yearning to breath free" The Statue of Liberty allegedly symbolizes the ideal of a new life and freedom offered to immigrants around the world.
In the case of Edmond Demiraj we said "Give us your testimony against a organized crime figure and we'll issue you and your family a green card to stay in the United States."
Approximately 10 days before the world witnessed the horror and tragedy of 9/11 government officials conferred with Edmond Demiraj. They had information he and his family had entered the United States illegally and used this information to broker a deal. The government of the United States wanted Mr. Demiraj to play ball. Their proposition? Federal Prosecutor, Marina Garcia Marmolejo, promised Mr. Demiraj if he became a government informer we would forego any action of deportation and issue a green card to him and his family to legally live in the United States and provide protection against any reprisals. Edmond Demiraj had worked in the construction business of Asqer "Bill" Bedini which was a front for criminal enterprises including human trafficking for sexual exploitation in the United States. Bedini, an Albanian mobster, has shown himself to be a powerful person capable of brutal violence. Despite the thread of violent retribution Demiraz agreed to take the risk to provide his family with a new life in the U.S. As it is prone to do the government dropped the ball. Knowing Bedini was a clever and formidable crime figure they did a poor job of surveillance After the mobster paid his bail and walked out of jail he subsequently made his way out of the country and returned to Albania. Now the government's ambitious plan to prosecute a organized crime figure was shattered. Suddenly Demitraq was expendable. The government didn't need him anymore because Bill Bedini was out of their clutches. Ignoring their promises the government forced Demiraj against his will to return to Albania.
Surprise, surprise. The spider was waiting for the fly. In March of 2003, Mr. Demiraj and his brother were abducted by Bidini and his henchmen. They beat both men severely and Bedini then shot Mr. Demiraj at close range.."I was on my knees and he pointed the gun straight at me," Demiraj told CNN. "He shot me." Demiraj says it was only luck that saved him. Neighbors, he said, heard the gunshot and came to his assistance. Bedini fled, leaving Demiraj with a bullet wound in his side and stomach. Although Mr. Demiraj survived, his physician later told him that he was lucky the bullet did not go through his kidney. Demiraj went to the local police and requested help but they refused to take any action against Bedini
Mr. Demiraj on the run and seeing no future living in Albania once again made the jump across the pond to America. He took the same route walking from Mexico and somehow slipping through the border crossing at Brownsville, Texas like many other Mexican nationals. Once he was back in the United States Demiraj contacted authorities about the violence aimed at him and his family in Albania This time the government granted withholding of removal. (asylum).
Now the plot thickens. For revenge and to teach a lesson to any foolhardy associate that would testify against him Bedini kidnapped two of the Demirajs' nieces in Albania and transported them to Italy, where the captors attempted to force the 19 and 21 year old girls into prostitution. When they were initially given clothes to wear for standing on the street, the girls began to cry and protest that they were not prostitutes. One captor, who may have been Bedini, became angry and beat the girls, saying that this was payback to your Uncle Edmund for when I was in the United States. Bedini's thugs then tied the nieces up for days with no food, water, or access to a toilet. Eventually, the nieces, who both had pain all over, felt sick and nauseated, and had urinated on themselves, consented to work as prostitutes. They were told to clean themselves up and to put on makeup. They were taken outside to the streets, where "the same man who shot Uncle Edmund gave them some condoms and told the nieces "how to use them for sex. Not long afterwards, the nieces, through sheer luck and a kind taxi driver, managed to escape from their captors and contact their family. Their family was horrified. If the nieces returned to Albania, Bedini would attack them again, and they feared the local police would refuse to intervene, as they had done after Mr. Demiraj was shot. In desperation the nieces finally fled to the United States and were granted asylum.
The nightmare was not over. Three years later, in 2006, Bedini and his associates abducted the nieces' younger sister at gunpoint and took the 19 year old to Germany. He beat her, cursing that he had warned your sisters not to escape from us because their family was going to pay for everything. Now you're going to pay for your sisters and your uncle. You better not do the same as your sisters. Following the same pattern of attempted exploitation of her sisters, this niece was taken to the streets for prostitution, but managed to escape, and fled to the United States, where she was granted asylum. In addition, the brother who was abducted with Mr. Demiraj has now fled to Greece, and Mr. Demiraj's parents, who have been threatened by Bedini, have gone into hiding.
At this point Demiraj and this three nieces had miraculously escaped a nefarious threat in Albania and secured asylum status in the United States. This was not the case for his wife, Rudina and first born son, Rediol They would have to swim upstream against a concerted effort by various government agencies to legally force them back to Albania despite the threat of retribution from crime boss, Bedini.
Before we go any further let's itemize the misdeeds of the government of the United States.

Deported a man back to his home country where he would face torture and murder
Put innocent family members related to Edmond Demiraj in danger from retaliation by an avenging mobster who attempted to force three innocent girls into prostitution.
After all the government had transgressed against Edmont Demiraj they were not done. Over the next 10 years various agencies would wage a concerned effort to expel Rudina Demiraq and her minor son, For the next 10 years the Demiraj family would wage a legal campaign against the formidable bureaucracies of the United States to stay in this country.
Eventually the Demiraq family would employ the services of the well known Orrick, Herrington & Sutcliffe law firm and be represented by attorney, Joshua Rosenkranz. American human rights and political action groups and a host of private American citizens including a number of high ranking former government officials. This small band would wage a David and Goliath war against the powers of the Federal government of the United States. After many deportation orders and legal wrangling between the Government and Mrs. Demiraj attorneys a major battle would be fought in the U.S. Court of Appeals for the Fifth Circuit.
Federal law grants asylum to non-citizens whose life or freedom would be threatened because they belong to a particular family, and no one in this case questions that the mobster would seek revenge against Demiraj's husband by going after her if she is returned to Albania. Nevertheless,
in a divided decision, a three-judge panel of the federal appeals court in New Orleans ruled against the Demiraj family. It is true, they said, that a federal law says asylum may be granted when an alien fears persecution on account of family membership. But the judges in the majority added that Mr. Demirajs wife and teenage son did not qualify. Their reasoning takes a minute to grasp. Mrs. Demiraj is at risk because Bedini seeks to hurt Mr. Demiraj by hurting her not because he has a generalized desire to hurt the Demiraj family as such, Judge Catharina Haynes wrote. Mrs. Demiraj would not be any safer in Albania if she divorced Mr. Demiraj and renounced membership in the family, nor would she be any safer if she were Mr. Demirajs girlfriend of many years rather than his wife. In other words the Fifth Circuit Court of Appeals of the United States has ruled Rudina and Rediol are not technically eligible for asylum, as their persecution would result from one family member's actions, not strictly on account of" membership in the Demiraj family itself. This has to be one of the landmark outrageously stupid and reckless rulings in the history of American federal courts. Even my little niece would have the common sense to say "bad guys in that country will hurt that lady and her boy." Needless to say the Demiraj family, their attorneys and allies were shocked and disheartened but they stayed the course and kept fighting. The next and only alternative move was to file an amicus brief and take this fight to the highest court of the land, the US Supreme Court.
On July 25, 2011, NIJC filed an amicus brief urging the Supreme Court to remand the case to the Board for a better-reasoned, logical decision. The NIJC amicus brief focuses on the inconsistent handling of the Demiraj family cases, and ambiguities in those decisions. In response Jennifer R. Khouri, a Justice Department lawyer, said at the appeals court argument in December There is a possibility that Mrs. Demiraj will be persecuted. I'm not saying she wont risk any harm in Albania. Im saying she hasnt met her legal burden when it comes to asylum." The idea that members of his family will be forced to return to Albania terrifies Mr. Demiraj.Bill Bedini is a dangerous person, Mr. Demiraj said on the phone the other day, in halting English. For sure hes going to kill my son. My wife, maybe hes going to kill her and maybe hes going to send her to prostitution. Mr. Demiraj and his nieces are now lawfully in the United States. He owns a small painting company near Houston. But the decision in January also brought bad news for Mr. Demiraj. It ordered the deportation of his wife, Rodina, and teenage son, Rediol, who have both lived in the United States since they entered the country unlawfully in 2000. (The two youngest Demiraj children were born in the United States.)
Never say die. That was the unspoken motto of Edmond Demiraj, his family, his attorneys and his support groups including political actions groups, human rights groups and a plethora of American University law professors but the most interesting supporting brief was filed by some 40 former federal law enforcement officials, including Dick Thornburgh, who was attorney general under Presidents Ronald Reagan and the elder George Bush, and William S. Sessions, who served as director of the F.B.I. in three administrations. Finally the newspapers and television media was getting wind of this remarkable story. This was turning into quite a firefight. After the amicus brief the case was headed for review by the Supreme Court. For the first time Edmond believed he had a good chance to win his freedom from the tyranny of the US government.
After the Justice Department asked the Supreme Court to extend its deadline to respond to the appeal 10 times, the Department of Homeland Security granted asylum to the three members of the Demiraj family. The couple also have two children born in the United States.
A spokesman for the department did not respond to a request for comment.
Joshua Rosenkranz, a lawyer with Orrick, Herrington & Sutcliffe, which represented the family, said he applauded the government's decision "to right a grave wrong."
Mr. Demiraj, who owns a small painting company near Houston, said on Tuesday that he had been "born again" after what had been "a nightmare."
It all came down to a political decision in the midst of a reelection campaign. Certain high ranking officials in the Obama administration realized the government persecuting an innocent family from Albania could turn into a media hailstorm and become ammunition for the Republicans to fire against the incumbent President. In other words some unknown but powerful government official pressured the Justice Department to cease their efforts to deport Rudina Demiraj and her son.
